Terms of Service

Welcome to MomoTokki. By accessing or using our platform — including our website, mobile applications, and any related services (collectively, the "Service") — you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years of age to use MomoTokki. By using the Service, you represent and warrant that you are 18 or older and that you have the legal capacity to enter into a binding agreement. If we discover that a user is under 18, we will immediately terminate their account.

The Service is not available to users who have previously been banned or suspended by MomoTokki, or to users prohibited from accessing it under applicable law.

2. Your Account

To use most features of MomoTokki, you must create an account. You agree to:

• Provide accurate, current, and complete information when registering
• Keep your password confidential and not share it with anyone
• Notify us immediately at [email protected] or through our Contact Us page if you suspect unauthorized use of your account
• Take responsibility for all activity that occurs under your account

You may not create an account on behalf of another person, impersonate any person or entity, or use a name that is offensive, vulgar, or violates any third-party rights.

3. Acceptable Use

MomoTokki is a social dating and networking platform. You agree to use the Service only for lawful purposes and in a manner that respects other users. You agree NOT to:

• Post, share, or transmit content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable
• Share sexually explicit content, nudity, or pornographic material
• Harass, stalk, intimidate, bully, or harm other users
• Post content that exploits or harms minors in any way
• Impersonate another person, create fake profiles, or misrepresent your identity or affiliation
• Use the Service to solicit money, financial information, or engage in scams or fraud
• Spam other users with unsolicited messages or promotional content
• Collect or harvest personal data about other users without their consent
• Use automated bots, scripts, or other means to access the Service
• Reverse engineer, decompile, or attempt to extract the source code of the Service
• Interfere with or disrupt the integrity or performance of the Service
• Use the Service for any commercial solicitation without prior written consent from MomoTokki
• Stream, broadcast, or display violence, self-harm, illegal activities, weapons, graphic content, or dangerous behavior during video sessions
• Use the Service in any way that could harm, endanger, or exploit any person, including yourself

We reserve the right to remove any content that violates these Terms and to suspend or terminate accounts of users who engage in prohibited conduct.

4. User Content

You retain ownership of content you post on MomoTokki ("User Content"), including photos, posts, comments, and profile information. By posting User Content, you grant MomoTokki a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely for the purpose of operating and improving the Service.

You represent and warrant that:

• You own or have the necessary rights to the content you post
• Your content does not violate the privacy, intellectual property, or other rights of any third party
• Your content complies with these Terms and all applicable laws

We do not endorse any User Content and are not responsible for content posted by users. You understand that by using the Service you may be exposed to content that you find offensive or objectionable. Use the reporting tools available in the app to flag inappropriate content.

You acknowledge that copies of your User Content may remain in backup systems or be retained where necessary for legal, security, or operational purposes, even after account deletion or content removal.

5. Video Chat, Speed Dating, and Debates

MomoTokki offers real-time features including video chat, speed dating events, and debate sessions. When using these features, you agree to:

• Treat all participants with respect and dignity
• Not record, screenshot, or capture video or audio of other users without their explicit consent
• Not expose yourself or others to nudity, explicit content, or harmful material during video sessions
• Not use video features to harass, threaten, or intimidate other users
• Participate in speed dating events in good faith and not intentionally disrupt events

Violations of these rules may result in immediate removal from events and permanent account suspension.

6. Points, Virtual Currency, and Shop

MomoTokki offers a points system that allows users to earn and spend virtual points within the Service. You acknowledge and agree that:

• Points have no real-world monetary value and cannot be exchanged for cash or any other currency
• Points are non-transferable between accounts
• Points may be earned through activity on the platform (login bonuses, game completions, etc.) and spent on virtual items in the shop
• MomoTokki reserves the right to modify, suspend, or discontinue the points system at any time
• Virtual items purchased with points are licensed to you, not sold, and have no monetary value
• We are not responsible for lost points resulting from account termination due to violations of these Terms
• MomoTokki reserves the right to modify, suspend, discontinue, or terminate any feature, service, virtual item, points balance, or portion of the platform at any time and without liability to you

7. Privacy

Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your personal information. By using the Service, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

8. Safety and Reporting

MomoTokki is committed to maintaining a safe community. If you encounter content or behavior that violates these Terms, please use the in-app reporting tools or contact us directly. We review all reports and take appropriate action, which may include content removal, account suspension, or cooperation with law enforcement.

MomoTokki reserves the right, but not the obligation, to remove, restrict, edit, or disable access to any content or account at our sole discretion and without prior notice, for any reason including violation of these Terms or potential harm to users or the platform.

9. User Interactions and Safety

MomoTokki is a platform that connects people for social interaction, video chat, speed dating, and dating. You are solely responsible for your interactions with other users, both on and off the platform.

Please be aware that:

• MomoTokki does not conduct criminal background checks on users and makes no representations about the character, background, or intentions of any user
• MomoTokki does not guarantee the identity of any user and cannot ensure that users are who they claim to be
• Users may not accurately represent themselves, their age, their location, or their intentions
• Any decisions you make to meet other users in person, share personal information, or engage in offline interactions are entirely at your own risk

We strongly encourage you to exercise caution when interacting with strangers online. Never share your home address, financial information, or other sensitive personal details with users you do not know and trust. If you choose to meet another user in person, do so in a public place and inform someone you trust of your plans.

MomoTokki is not responsible for the conduct of any user, whether online or offline, and expressly disclaims all liability arising from user interactions.

10. Intellectual Property

The Service, including its design, logos, graphics, software, and content created by MomoTokki, is owned by MomoTokki, LLC and protected by copyright, trademark, and other intellectual property laws. You may not use, copy, reproduce, or distribute any part of the Service without our prior written permission.

The MomoTokki name, logo, and related marks are trademarks of MomoTokki, LLC. You may not use these marks without our express written consent.

11. Account Termination

You may delete your account at any time through the Settings page in the app. Deletion requests are subject to a 30-day grace period during which you may restore your account. After 30 days, your account and associated data will be permanently deleted.

MomoTokki reserves the right to suspend or permanently terminate your account at any time, with or without notice, if we determine that you have violated these Terms, engaged in fraudulent or illegal activity, or if your continued use poses a risk to other users or the platform.

Upon termination, your right to use the Service ceases immediately. Points and virtual items associated with a terminated account are forfeited.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

MomoTokki does not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not guarantee that you will find matches, connections, or relationships through the Service.

We are not responsible for the conduct of any user, whether online or offline, and make no representations about the accuracy or reliability of any User Content.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, MOMOTOKKI AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF ONE HUNDRED DOLLARS ($100) OR THE AMOUNT YOU PAID TO MOMOTOKKI IN THE TWELVE MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless MomoTokki and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law and Dispute Resolution

These Terms constitute a legal agreement between you and MomoTokki, LLC, a Texas limited liability company. These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, on an individual basis and in Texas. You waive any right to participate in a class action lawsuit or class-wide arbitration.

Nothing in this section prevents either party from seeking injunctive or other equitable relief for violations of intellectual property rights or unauthorized access to the Service.

16. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date at the top of this page and, where appropriate, by sending a notification through the Service. Your continued use of MomoTokki after changes take effect constitutes your acceptance of the revised Terms.

We encourage you to review these Terms periodically to stay informed of any updates.

17. Copyright Infringement (DMCA)

MomoTokki respects the intellectual property rights of others and expects users to do the same. If you believe that content posted on MomoTokki infringes your copyright, please send a notice to [email protected] with the following information:

• A description of the copyrighted work you believe has been infringed
• A description of where the infringing content is located on the platform
• Your contact information (name, address, email, phone number)
• A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf
• Your electronic or physical signature

We will investigate valid DMCA notices and take appropriate action, which may include removing the infringing content and, in cases of repeat infringement, terminating the user's account.
